Sense of Wonder Site Event
General Waiver, Release, and Indemnification Agreement
In consideration of the acceptance of my reservation with, and/or payment of the necessary fee to, the Sense of Wonder Site ("SWS") for a certain event ("SWS Event") and/or being allowed to participate, observe, work for, or for any purpose participate in the SWS Event, the sufficiency of such consideration being specifically agreed to and acknowledged, I for myself, my family and guest(s) with whom I may bring to any SWS Event, and each of the aforementioned persons' heirs, assigns, and next of kin (hereinafter, "My Party") do hereby acknowledge, agree and represent that:
1) I HEREBY RELEASE, WAIVE, DISCHARGE, any and all claims I may have against SWS, Wendy A. Figone and its organizers, and any service providers and facilities providers with which the SWS Event is coordinated and covenant not to sue any of the aforementioned persons, including but not limited to, any owners and lessees of premises used to conduct any activity associated with the SWS Event and for each of them their officers and employees (hereinafter referred to as "Releasees") from all liability to My Party for any and all damages, and any claim or demands therefore on account of any injury, damage to property, or resulting death or incapacity to My Party, whether caused, in whole or in any proportion, by negligence of the Releasees and/or from My Party observing, working for, or in any way participating in or travelling to or from any activity associated with the SWS Event.
2) I HEREBY AGREE TO INDEMNIFY, SAVE, AND HOLD HARMLESS the Releasees, individually and as a group, from any costs or expenses they may incur, as a direct result of any from any loss, liability, damage, or cost caused by My Party observing, working for, or for any purpose participating in or travelling to or from any activity associated with the SWS Event.
3) I HEREBY EXPRESSLY AGREE that this release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by law, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
4) I HEREBY ACKNOWLEDGE that I have sole responsibility for the safety and well-being of My Party and each and every of My Party's personal possessions during the SWS Event and its related activities. I HAVE READ AND I ACCEPT THIS RELEASE, WAIVER, AND INDEMNITY AGREEMENT AND FURTHER AGREE THAT NO ORAL REPRESENTATIONS, STATEMENT OR INDUCEMENTS APART FROM THE FOREGOING WRITTEN AGREEMENT HAVE BEEN MADE.
